Contract of sale

All items displayed for sale on the website are currently in stock. However, there will be rare occasions when breaks in supply occur. If an item is out of stock, it will be removed from the online shop. Hummingbird  reserves the right to withdraw items for sale at any time. If your website purchase coincides with a break in supply, this purchase will not be a contract of sale with Hummingbird . You will be contacted by Hummingbird  and offered the opportunity to wait to purchase the item(s) of your choice when it/they arrive back in stock or cancel the sale. If part of your order is not available, we will contact you for authorisation to make a partial delivery. 

You have the right to cancel your order at any point before postage. Following postage you still have the right to cancel your order in line with our returns policy outlined below.

Making a purchase

When you purchase an item from the Hummingbird  online shop, you will receive an email confirming receipt of your order, a unique order number and other essential information relating to your sale and cancellation rights. When your item has been posted, you will receive an email confirming your purchase has been dispatched. You will normally receive a confirmation of postage email within one to two working days of your order being received and processed. Unless your purchase coincides with a break in supply, orders will not take more than two working days to be dispatched. Most orders are dispatched on the same or next working day with the exception of Bank Holidays. Orders placed at the weekend will normally be posted at the beginning of the following week. In the unlikely event that the postage of your item is delayed, Hummingbird  will contact you to inform you of the date on which you can expect delivery.

If you have any special requirements for postage, please contact us at the time of your order. We will be happy to try and meet these requirements.

Pricing

All prices shown on the Hummingbird website are inclusive of VAT where applicable and at the current rate. Prices exclude postage costs, which are highlighted separately.

We cannot be held responsible for typographical errors on this site, including but not limited to those including price. Hummingbird  reserves the right to change our terms and conditions and product and price information without any notice being given.

Packaging

We make every effort to package your items attractively, safely and securely. It is important that you retain this packaging if you want to make a return.

Postage

All items ordered will be sent via anPost.

Your right to cancel your order and how to make a return

We very much hope you like your purchases but if you would like to return them, please find below your cancellation rights and our returns procedure.

Contract of sale: All of our products for sale on the website are currently in stock. However, there will be rare occasions when breaks in supply occur. If an item is out of stock, it will be removed from the online shop. The Merry Mill reserves the right to withdraw items for sale at any time. If your website purchase coincides with a break in supply, this purchase will not be a contract of sale with The Merry Mill. You will be contacted by The Merry Mill and offered the opportunity to wait to purchase the item(s) of your choice when it/they arrive back in stock or cancel the sale. If part of your order is not available, we will contact you for authorisation to make a partial delivery. You have the right to cancel your order at any point before postage. Following postage you still have the right to cancel your order in line with our returns policy.

Effects of cancellation

If you cancel your sales contract with us, we will refund all costs received from us, including the cost of delivery. You will bear the direct costs of posting the goods back to us.  If you return only part of your order then we will refund proportional postage costs.

All returns will be quality checked. We may make a deduction from your reimbursement for loss in value of any goods supplied if the loss is a result of unnecessary handling, wear or damage by you. You will also lose your right to cancel if you unseal goods that are not suitable for returns owing to health protection or hygiene reasons. If you are unsure about the purchase of earrings from us, under no circumstances must you place these through the ear.

Refunds will be issued within 14 days of receiving the goods and we will send you an email to confirm that the refund has taken place. We will make the refund using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise.

If you would like to exchange your items, we will refund or charge for any difference between the price of the goods purchased.

In the unlikely event that you feel that the item you have received is faulty, please send the item back to us using the returns procedure below. If we agree the item is faulty, we will provide you with a refund or exchange and a refund for all postage costs.

Security

Hummingbird understands that you want to shop securely and with confidence. It therefore uses an online secure payment service provider to process your card payment. This provider uses state-of-the-art internet solutions to ensure that the personal and sensitive data you provide when making a purchase from us is not compromised. We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we cannot be held liable for any unauthorised access to information provided by you.

We reserve the right to modify or withdraw, permanently or temporarily, this website or part of this website without notice to you and to modify our terms and conditions. It is your responsibility to check whether any changes have been made to our terms and conditions and to stop using our website if you do not agree to these changes.

Use of our website

Quality: We take great care to accurately describe and photograph each item, but the colour and finish of items may vary when you use different computer screens. We want you to purchase from the Hummingbird website with confidence. However, in the unlikely event that you are not satisfied with your purchase, please get in touch with us and we will attempt to put things right or arrange for a return. Please see our returns policy for more information. Once purchases have arrived undamaged with yourself, then risk of loss or damage is then passed to you the customer.

Our rights: We reserve the right to modify or withdraw, permanently or temporarily, this website or part of this website without notice to you and to modify our terms and conditions.It is your responsibility to check whether any changes have been made to our terms and conditions and to stop using our website if you do not agree to these changes.

Use of our website: All use of the The Hummingbird website must be lawful and not injurious to any third party. You must not copy the content or images contained within the The Hummingbird web pages for commercial purposes without the written consent of The Hummingbird. You must also not use The Hummingbird’s website in any way that undermines the credibility of The Hummingbird website or Hummingbird.
